Welcome to VANTUSCART. By accessing, browsing, or purchasing from this website (the "Services"), you agree to be bound by the following Terms of Service. If you do not agree to these terms, please do not use our website.

Section 1: Account & Access

To access our Services or make a purchase, you represent that you are at least 18 years of age (the age of majority in the Republic of India). You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Section 2: Products & Representations

We make every effort to display the colors, features, and specifications of our products accurately.

  • Statutory Compliance: In compliance with the Legal Metrology (Packaged Commodities) Rules, 2011, all mandatory declarations, including Maximum Retail Price (inclusive of all taxes), Country of Origin, and net quantity, are clearly displayed on our product pages.
  • We reserve the right to limit the quantities of any products we offer and to discontinue any product without prior notice.

Section 3: Orders, Pricing & Refunds

Your submission of an order constitutes a legal offer to purchase. A contract is formed only when VANTUSCART explicitly accepts your order and processes your payment.

  • Refunds: Eligible returns and cancellations are governed by our Refund Policy. For accepted cancellations, VANTUSCART will process your refund to the original payment method within a maximum of fourteen (14) business days, in accordance with the Consumer Protection (E-Commerce) Rules, 2020.
  • All purchases must be for personal use. Commercial resale is strictly prohibited.

Section 4: Shipping & Title

Delivery timelines provided at checkout are estimates. The title to the products and the risk of loss or damage pass to you the moment we transfer the goods to the third-party shipping carrier.

All content on this website (text, graphics, logos, images) is the exclusive property of VANTUSCART. Our original content is protected under the Copyright Act, 1957, and our brand identity is protected under the common law rights of passing off under the Trade Marks Act, 1999. You may not copy, reproduce, or distribute any part of this website without our written consent.

Section 6: Third-Party & Shopify Disclaimers

Our store is hosted on Shopify Inc. You acknowledge that your commercial contract is exclusively with VANTUSCART. You agree to release Shopify Inc. from any damages arising from your purchase or use of our products.

Section 7: Privacy & Data Protection

We collect and process your personal information in strict compliance with the Digital Personal Data Protection (DPDP) Act, 2023. Your rights regarding your data are outlined in our Privacy Policy.

Section 8: Ethical Commerce & Prohibited Uses

  • Ethical Commerce: We comply with the Guidelines for Prevention and Regulation of Dark Patterns issued by the Central Consumer Protection Authority (CCPA).
  • Prohibited Conduct: You agree not to use the Services to violate any applicable laws, including the Information Technology Act, 2000, or to interfere with the website's security features.

Section 9: Warranties & Limitation of Liability

EXCEPT AS EXPRESSLY STATED IN OUR RETURN POLICY, THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" BASIS. VANTUSCART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW. VANTUSCART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.

Section 10: Force Majeure

VANTUSCART shall not be liable for any delay or failure to perform our obligations if caused by events beyond our reasonable control, including natural disasters, carrier strikes, grid failures, or government edicts.

Section 11: Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Your continued use of the Services following any changes constitutes your acceptance of those modifications.

Section 12: Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. In the event of a dispute, you agree to contact our Grievance Officer and allow thirty (30) days for negotiation. Unresolved disputes shall be settled by binding arbitration in Kochi, Kerala, India. You consent to the exclusive jurisdiction of the courts in Kochi.

Section 13: Grievance Redressal

Pursuant to the IT Act, 2000, and Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer will acknowledge complaints within 48 hours and attempt resolution within one month.
